Derelict Sites
Derelict Sites Act 1990
Each local authority is responsible for dealing with derelict sites in its area. Under the Derelict Sites Act 1990 local authorities must manage derelict sites. The Act allows local authorities to prosecute owners who do not comply with notices served, to purchase land compulsorily; and to carry out necessary work themselves and charge the owners for the cost.
A “derelict site” means any land (in this section referred to as “the land in question”) which detracts, or is likely to detract, to a material degree from the amenity, character or appearance of land in the neighbourhood of the land in question because of--
(a) the existence on the land in question of structures which are in a ruinous, derelict or dangerous condition, or
(b) the neglected, unsightly or objectionable condition of the land or any structures on the land in question, or
(c) the presence, deposit or collection on the land in question of any litter, rubbish, debris or waste, except where the presence, deposit or collection of such litter, rubbish, debris or waste results from the exercise of a right conferred by statute or by common law.

Derelict Sites Register
Every local authority is obliged, by law, to establish and maintain a register to be known as “the derelict sites register”. The register shall be kept at the offices of the local authority and shall be available for inspection at the offices of the local authority during office hours.
What happens when a site is added to the Derelict Sites Register?
If a site that you own is added to the Derelict Sites Register, Dublin City Council has the authority to do the following:

- The Council can demand that you restore your site to a non-derelict condition within a certain time period. You are normally given 6 weeks to complete such work. A financial penalty may be imposed if you fail to do so.
- The Council can apply a financial penalty on you. This could amount to 3% of market value of your derelict site for every year it remains on the Derelict Sites Register.
- The Council can purchase property by agreement or by compulsory purchase order.

Available at Clare County Council, Áras Contae an Chláir, New Road, Ennis, Co. Clare. The register is paper based.

Cork County Council Derelict Sites Register
Available on Floor 5 at the Cork County Council Headquarters, County Hall, Carrigrohane Road, Cork.
This would include South Cork area. North and West Cork would also have this arrangement. The Municipal Areas would also have a register. The Registers for West Cork Municipal District Area are available for inspection at the West Cork Municipal Office in Clonakilty. These Registers are currently being updated and the new Registers are not available for inspection until the process is complete.
